The Yemeni president announces the transfer of his full powers to a new presidential council
On Thursday, April 7, 2022, the Yemeni president announced the transfer of his full powers to the new presidential leadership council, so that the council will take over the political, military, security and economic management of the state.
The resolution comes in conjunction with the Yemeni-Yemeni consultations, which the Gulf Cooperation Council called for in Riyadh, hours before the final announcement of the consultations.
The council is chaired by Dr. Rashad Mohammed Al-Alimi (ex-adviser to Abd Rabbo, former Minister of the Interior), and the membership of 7 members are:
- Sultan Al-Arada (a tribal sheikh and governor of Marib Governorate),
- Tariq Saleh (nephew of Ali Abdullah Saleh and former commander of the Special Guard),
- Abdul Rahman Abu Zara’a ( Salafi leader and commander of the Alamalqa South Forces),
- Dr. Abdullah Al-Alimi Bawazir (former office manager of the President of the Republic of Yemen),
- Othman Majali ( sheikh, Yemeni parliamentarian, and party leader from the Popular Congress Party),
- Aidarous Al-Zubaidi (former governor of Aden and head of the Southern Transitional Council),
- Faraj Al-Bahsani (formerly the governor of Hadhramaut, the largest Yemeni governorate and the military commander of eastern Yemen).
Each member of the Presidential Leadership Council has the rank of Vice President, and the text of the resolution is “the formation of the Presidential Leadership Council, to complete the implementation of the tasks of the transitional phase, authorizing the Presidential Leadership Council, pursuant to this announcement, an irreversible delegation of all my powers in accordance with the constitution, the Gulf initiative and its executive mechanism.”
As stated in the resolution, “The Presidential Command Council shall negotiate with (Ansar Allah) the Houthis for a permanent ceasefire throughout the republic and sit at the negotiating table to reach a final and comprehensive political solution that includes a transitional phase that will move Yemen from a state of war to a state of peace. “
The second article of this decision stated the formation of the Consultation and Reconciliation Commission, consisting of 50 personalities of various Yemeni components, working to unify and bring together the national forces to strengthen the efforts of the Presidential Leadership Council and create the appropriate conditions to stop fighting and conflicts between all forces and reach the peace that achieves security and stability in Yemen.
The third article of this decision mentioned the formation of the legal team, which is to formulate the draft rules regulating the work of the Presidential Leadership Council, the Consultation and Reconciliation Commission, the legal team, and the economic team headed by Ismail Ahmed Al-Wazir (chairman of the 2014 Constitution Drafting Committee and former Minister of Justice) and 9 other members.
The fourth article of the decision mentioned the formation of the economic team, and the team will be headed by Hussam Al-Sharjabi (former Deputy Minister of Finance) and the membership of 14 prominent Yemeni economic figures and businessmen. The tasks of the economic team are:
1) Supporting government reforms and providing advice and advice to the government and the Central Bank regarding urgent reforms in the economic, development, financial and monetary fields.
2) Work to enhance efficiency, transparency, and integrity in government agencies.
3) Studying economic challenges, working to lay the foundations for sustainable development, drawing the necessary plans for economic development, and offering stimulating solutions for economic growth.
4) Work to increase state revenues, raise the efficiency of collection, and diversify the economic base.

President of the Republic:
Based on the powers granted to us by the Constitution of the Republic of Yemen in embodying the will of the people, respecting the constitution and the law, protecting national unity, the principles and objectives of the Yemeni revolution, committing to the peaceful transfer of power and supervising the sovereign tasks related to the defense of the Republic and those related to the foreign policy of the state.
Based on the Gulf initiative and its implementation mechanism.
In addition, in accordance with Article 9 of the executive mechanism of the Gulf initiative, which stipulates the need to take all necessary legislation to implement the guarantees contained in the Gulf initiative, the most important of which is meeting the aspirations of our people for change and reform, and removing the elements of political and security tension.
In my capacity as the President of the Republic of Yemen, and with a desire to involve effective leaders in managing the state in this transitional phase, and affirming our commitment to Yemen’s unity, sovereignty, independence, territorial integrity and territorial integrity, and sensing historical, national and humanitarian responsibility in the current circumstances that the country is going through in all its lands, and facing humanitarian and political crises that resulted from the wars between our people, and in order to overcome the difficulties and obstacles that were placed in the way of achieving our people’s aspirations to build a new Yemen, and to achieve the requirements of our people in preserving the social fabric and stopping the bloodshed, healing the wounds, embodying the goals of the glorious September and October revolutions, and preserving the unity of our people in a state A civil society that achieves broad partnership and equitable distribution of wealth, protects everyone, and achieves the essence of the outcomes of the comprehensive national dialogue, and in our desire to preserve the bonds of brotherhood among all our people, and based on the principles that our people believe in and the need to achieve their aspirations for a comprehensive and lasting peace, and in order to preserve the security of citizens All and stability of the security of the homeland and the integrity of its territory, and to complete the tasks of the transitional period and to implement the consensus of the people our honorable play;
We issued a declaration of the transfer of power as follows:
Article 1: The Presidential Leadership Council.
(A): Pursuant to this declaration, a Presidential Leadership Council shall be established to complete the implementation of the tasks of the transitional period, and I hereby authorize the Presidential Leadership Council to irrevocably delegate my full powers in accordance with the constitution and the Gulf initiative and its executive mechanism.
(B): The Presidential Leadership Council, in addition to its above-mentioned powers, has all the powers of the Vice President.
(C): The Presidential Leadership Council will be headed by Rashad Mohammed Al-Alimi, and the membership of seven members are:
(1) Sultan Ali Al-Arada.
(2) Tariq Mohammed Saleh.
(3) Abd al-Rahman Abu Zara’a.
(4) Abdullah Al-Alimi Bawazeer.
(5) Othman Hussein Megali.
(6) Aidarus Qassem Abdulaziz Al-Zoubaidi.
(7) Faraj Salmin Al-Bahsani.
(D): Each member of the Presidential Leadership Council shall have the rank of Deputy Chairman of the Presidential Leadership Council.
(E): The President and members of the Presidential Leadership Council shall abide by the principle of collective responsibility and strive to achieve the highest degree of consensus among them.
(F): The Presidential Leadership Council has the following competencies:
1) Managing the country politically, militarily and security throughout the transitional period.
2) Adopting a balanced foreign policy that achieves the supreme national interests of the state and builds it on the basis of independence and common interests in a manner that preserves the sovereignty, security and borders of the state.
3) Facilitating the government’s exercise of its powers in full during the transitional period.
4) Adopting the necessary policies to enhance security and combat terrorism throughout the Republic of Yemen.
Forming the joint security and military committee to achieve security and stability by adopting policies that would prevent any armed confrontations throughout the republic, creating conditions and taking the necessary steps to achieve the integration of the armed forces under a unified national command structure within the framework of the rule of law, and ending the division in the armed forces Addressing its causes, ending all armed conflicts, establishing a national doctrine for members of the army and security services, and any tasks the Council deems to promote stability and security.
6) Enhancing equality among citizens in all rights and duties and achieving broad partnership.
(G): The President of the Presidential Leadership Council shall exclusively have the following powers and authorities:
(1) The Supreme Command of the Armed Forces.
(2) Representing the Republic at home and abroad.
(3) Appointing governorate governors, security directors, Supreme Court judges and the governor of the Central Bank, after consulting with the Prime Minister, provided that the names are agreed upon with members of the Presidential Leadership Council, and in case of disagreement, the decision is presented according to the decision-making mechanism mentioned in paragraph (k) of this article.
(4) Ratification of agreements that do not require ratification by the Council of Representatives after the approval of the Council of Ministers.
(5) Establish diplomatic missions and appoint and recall ambassadors in accordance with the law.
(6) Inviting the Council of Ministers to a joint meeting with the President of the Presidential Leadership Council whenever the need arises.
(7) Declaring a state of emergency and general mobilization in accordance with the constitution and the law, unless the Presidential Leadership Council, by a two-thirds majority, decides not to declare.
8) Calling the regular and extraordinary sessions of the Presidential Leadership Council.
(H): Vacancies for the President and Members of the Presidential Leadership Council:
(1). In the event of the death, disability, or resignation of the President of the Presidential Leadership Council, the council is headed by the eldest member and continues as the council’s chairman unless the Presidential Leadership Council deems it necessary by consensus or by a two-thirds majority vote to choose another head of the council’s members.
(2). The rules governing the work of the Presidential Leadership Council deal with the death, incapacity or resignation of a member of the Council.
(I): The Chairman of the Presidential Leadership Council or his representative determines the place and time of the sessions in the invitation he sends to the members. presidency when needed.
(J): No member of the Presidential Leadership Council may refuse to participate in council meetings except for reasons of death, disability, terminal illness, or an urgent necessity that prevents him from attending.
Decisions of the Presidential Leadership Council are issued by consensus, and in the event of inconsistency, the following shall be implemented:
(1). Decisions are taken upon voting by a simple majority, and in the event of a tie, the side voted for by the President of the Presidential Leadership Council shall prevail.
(2). If a simple majority is not present, the matter is referred to a joint meeting with the Presidency of the Consultation and Reconciliation Commission.
(3). Decisions are made in the joint meeting of the Presidential Leadership Council and the Presidency of the Consultation and Reconciliation Commission by a simple majority of those present, and when the votes are equal, the side for which the President of the Presidential Leadership Council voted shall prevail.
(4). If it is not possible to have a simple majority of the attendees at the joint meeting, the Chairman of the Presidential Leadership Council decides the decision.
(L): The President of the Presidential Leadership Council issues presidential decrees and decisions to implement the decisions of the Council within (24) hours after voting on the decision.
(M): The President of the Presidential Leadership Council approves the rules regulating the work of the Presidential Leadership Council, the Consultation and Reconciliation Commission, the legal team, and the economic team formed under this announcement within (15) days from the date of submitting the legal team’s recommendation of the draft organizing rules, and it is issued by law.
(N): The President of the Presidential Leadership Council decides the necessary executive procedures for the conduct of the work of the Presidential Leadership Council, the Consultation and Reconciliation Commission, the legal team and the economic team until the adoption of the organizing rules.
Article 2: Consultation and Reconciliation Commission.
(A): In accordance with this declaration, a body will be established that brings together the various components to support and support the Presidential Leadership Council and work to unify and gather national forces in a way that enhances the efforts of the Presidential Leadership Council and create the appropriate conditions to stop the fighting and conflicts between all forces and reach peace that achieves security and stability throughout the Republic.
(B): The commission works to unify the visions and objectives of the various national forces and components, in a way that contributes to restoring state institutions and consolidating Yemen’s belonging to its Arab incubator.
(C): The Commission is composed of fifty members as follows:

(D): The Consultation and Reconciliation Commission elects its executive presidency from among its members in its first session, based on an invitation from the President of the Presidential Leadership Council.
(E): The President of the Presidential Leadership Council appoints whomever he deems fit to be a member of the Commission when needed, provided that the number of members does not exceed one hundred members.
Article 3: The legal team.
(A): A legal team of competent national competencies shall be formed to draft the rules regulating the work of the Presidential Leadership Council, the Consultation and Reconciliation Commission, the legal team and the economic team formed under this declaration, and it shall be submitted within (45) days from the date of this declaration to the President of the Presidential Leadership Council for approval and issued by law. The team may submit its advisory opinion on legislative and constitutional issues to the Presidential Leadership Council upon a request from the council chairman.
(B): The team shall be headed by Ismail Ahmed Al-Wazir and the membership of each of the following:
(1) Ahmed Zabin Attia.
(2) Ahmed Arman.
(3) Ghaleb Abdul Kafi Al-Qurashi.
(4) Hamoud Abdel Hamid Al-Hatar.
(5) Abbas Mohammed Mohammed Zaid.
(6) Mohammed Salih Ali.

Article 5: The House of Representatives and the Shura Council.
The mandates of the House of Representatives and the Shura Council shall continue in their duties entrusted to them.
Article 6: The Government of Competencies.
This announcement renews confidence in the government formed under the Riyadh Agreement, with the Presidential Leadership Council taking what it sees as its powers to make amendments or changes in the government, or form a new government.
Article 7: A comprehensive political solution.
The Presidential Command Council is in charge of negotiating with (Ansar Allah) the Houthis for a permanent ceasefire throughout the republic and sitting at the negotiating table to reach a final and comprehensive political solution that includes a transitional phase that will move Yemen from a state of war to a state of peace.
Article 8: End of the Presidential Leadership Council’s work.
The term of the Presidential Leadership Council ends in accordance with a comprehensive political solution and the establishment of complete peace throughout the republic, which includes defining the transitional phase and its requirements, or when general elections are held in accordance with the new constitution and the inauguration of the new president of the republic.
Article 9: Inconsistency.
This declaration supersedes what contradicts its provisions in the constitution and laws.
